TERMS OF SERVICE AGREEMENT

Please read this Terms of Service Agreement to understand the legal contract between you and P Mac Insights, LLC. You must agree to these terms or discontinue use of any P Mac Insights free and/or paid content (the ‘content’) on pmacinsights.com, subdomains, or in other locations.
By using the content, you agree to the terms and conditions of this Agreement and the Privacy Policy.
You affirm that you are 21 or more years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement.
P Mac Insights, LLC is operated in facilities in the United States of America. Access or use of the content from other jurisdictions do so at their own and are responsible for compliance with their local law.
The information in this Terms of Service Agreement are between You the user and P Mac Insights, LLC and does not include third-parties represented in the content.
1. GENERAL USE OF THE SERVICES
P Mac Insights hereby grants you the right to use the content with these following conditions:
a. You agree not to distribute any content without P Mac Insights’’s prior written authorization.
b. You agree not to alter or modify any part of the content.
c. You agree not to use or sell content for any commercial use without the prior written authorization of P Mac Insights.
d. You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” that accesses the Services in a manner that sends more request messages to the P Mac Insights servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.
e. You agree to comply with the terms and conditions of this Agreement, and all applicable local, national, and international laws and regulations.
f. P Mac Insights reserves the right to discontinue any aspect of the Services or services at any time.
g. You agree to not exploit any of the P Mac Insights Content nor use, copy, reproduce, transmit, broadcast, sell, license, or download unless permitted to do so.
h. You understand that when using the content, you will be exposed to Customer Content. P Mac Insights is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Customer Content. By using the content, you understand that you may be exposed to Customer Content that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, P Mac Insights liable for the Customer Content.
2. Confidentiality
P Mac Insights does not assume the risk of information shared over the internet. However, will ensure safeguards to keep your information secure as described in our privacy policy.
3. COPYRIGHT INFRINGEMENT
All images, trademarks and intellectual property are owned by P Mac Insights, LLC with the exception of website programs, codes, and building features. None of the content may be downloaded, copied, redistributed unless with prior written consent. You agree to use the website for non-commercial home use only.
4. WARRANTY DISCLAIMER
By using this site, you agree that the content and or products and services are used at your sole risk. The content and products and services are provided “as is” and is “as available” basis. P Mac Insights makes no warranties, expressed or implied, with results. USE AT YOUR OWN RISK.

6. LIMITATION OF LIABILITY
You agree to not hold P Mac Insights, LLC liable for any damages, punitive or otherwise by participating in the content.
7. INDEMNITY
You agree to defend, indemnify, and hold harmless P Mac Insights from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of this Agreement; (iii) your violation of any third-party rights, including without limitation any copyright, property, or privacy right; or (iv) any claim that Customer Content caused damage to a third party or to P Mac Insights. This defense and indemnification obligation will survive this Agreement and your termination of use of the Services.
8. TERMINATION POLICY
You may stop using the content at any time. P Mac Insights, LLC also reserves the right to terminate this Agreement at any time for any reason without prior notice. You remain solely liable for all obligations of the services even after you have stopped using the services described in the content.
9. THIRD-PARTY SITES
P Mac Insights has no control over and assumes no responsibility for the third-party links and websites that are not owned or controlled by P Mac Insights. By using the website content, you relieve P Mac Insights from any and all liability arising from your use of any third-party service.
10. NOTICE REGARDING ELECTRONIC PAYMENT VENDORS
P Mac Insights uses third-party payment processors through electronic payment vendors and may provide applications and services related to merchants payment processing. Payments can be denied for various reasons such as illegal or other prohibited activities.
Your information you share on the electronic payment vendor’s site is separate from your relationship with P Mac Insights. See their terms and conditions to understand your agreement. P Mac Insights is not responsible for the actions or omissions of these payment processors on this site.
11. TYPOGRAPHICAL ERRORS
P Mac Insights makes every effort to accurately input information but may have some errors and may or may not make corrections in a timely manner.
15. USERS UNDER 21 YEARS OF AGE
The content on P Mac Insights, LLC website, social media, and or other areas are not directed to persons under the age of 21. If you become aware that your child has provided us with personal information without your consent, please contact us at pmacinsights@gmail.com. We do not knowingly collect personal information from children and if we learn that a child has participated in our site, we take steps to remove such information. By using the Services, you are representing to us that you are not under the age of 21. If you are under 21 years of age, you are not authorized to install and use the Services and must immediately delete it from your devices.
16. GENERAL
By submitting your information to this website, you consent to receive electronic communications of all kinds, promotional included, from P Mac Insights.
17. APPLICABLE LAW
The Terms of this Agreement are in accordance of Idaho Law and hereby submit exclusive jurisdiction of the State of Idaho or USA federal law.
18. REFUND POLICY
P Mac Insights, LLC wants you to be satisfied with any purchase you have made within the site. For any problems with purchases you have made, please contact pmacisinghts@gmail.com
Refunds for purchases must be sent to pmacinsights@gmail.com within 14 calendar days of purchase unless otherwise specified in a separate agreement.
19. MODIFICATIONS
The Terms of Service may be modified without any notice. Should you access the updated terms, you will adhere to the current terms.
21. FORCE MAJEURE
Should P Mac Insights become unable to perform its obligations or provide the Services under the terms of this Agreement because of acts of God (including, but not limited to, severe acts of nature or weather events including floods, fires, earthquakes, hurricanes, or explosions), strikes or labor disputes, war, riots, acts of terrorism, epidemics, pandemics, acts of governmental authorities (including but not limited to government directives, expropriation, condemnation, and changes in laws and regulations), interruptions, loss, or malfunctions of utilities, communications, or computer (software and hardware) services, or other causes reasonably beyond P Mac Insights’s control, P Mac Insights shall not be liable for any costs or damages resulting from P Mac Insights’s failure to perform its obligations under the terms of this Agreement, provide the Services, or otherwise, from such causes.
22. DONATIONS
P Mac Insights is a for-profit limited liability company and donations are NOT TAX DEDUCTIBLE. P Mac Insights reserves the right to use your donation in any manner unless specified in writing by the doner. Contact pmacinsights@gmail.com with your donation requests.
